Terms and conditions

These terms and conditions (“Terms”) govern the use of the NOVATEIRRA platform (the “Service”) and any booking made through it. By creating an account or completing a booking, you confirm that you have read, understood and accepted these Terms.

1. Operator

The Service is operated by Saúl Fernando Covarrubias Pelcastre, a Mexican individual taxpayer (persona física con actividad empresarial) with tax ID (RFC) COPS000611HZA, doing business under the commercial name NOVATEIRRA, with fiscal address at Datililo M 22 L #28, Col. Ejido Cabo San Lucas, Migriño, Los Cabos, Baja California Sur, Mexico, C.P. 23450 (hereinafter “NOVATEIRRA”).

2. Object of the Service

NOVATEIRRA operates a verified portfolio of short and mid-term stays and acts as the direct commercial counterpart of every booking made through the platform. The Service includes:

  • Search and visualisation of available properties.
  • Booking, payment and confirmation.
  • Booking management (modification, cancellation, additional guests, Wallet integration).
  • Customer support before, during and after the stay.

3. Account and use

To make a booking you must be at least 18 years old and provide accurate, complete and up-to-date data. You are responsible for keeping your credentials confidential and for all activity carried out through your account.

You agree to use the Service in good faith and in compliance with applicable law. The following are prohibited:

  • Providing false data or impersonating another person.
  • Using the Service for illegal activities or activities contrary to public order.
  • Reselling reservations or commercialising bookings outside the platform.
  • Interfering with the integrity or security of the platform.

4. Prices, VAT and payment

  • Prices are shown in MXN. Any conversion to other currencies is informative; the charge is processed in MXN.
  • All prices include Value Added Tax (IVA) at 16% unless otherwise stated in the price breakdown.
  • Service fees, cleaning fees and applicable deposits are disclosed in the checkout breakdown before payment.
  • Payments are processed exclusively through Stripe. NOVATEIRRA does not accept bank transfers, cash or off-platform payments.
  • The exchange rate applied by Stripe, your issuing bank or the card network may modify the final amount in your local currency until the payment is confirmed.

A tax receipt (CFDI) can be requested up to the last day of the calendar month in which the booking is paid, by writing to [email protected] with the buyer’s tax data.

5. Cancellation and modifications

Cancellations are governed by the Cancellation policy. The policy of the property prevails over generic conditions and is displayed before checkout. Modifications to dates or guests are subject to availability and may generate a price difference.

6. Obligations of the guest

  • Use the property in compliance with house rules and condominium rules.
  • Respect check-in and check-out hours.
  • Take care of the property and report any damage immediately.
  • Provide accurate information about the number of guests.
  • Cover any damage caused beyond ordinary wear and tear.

7. Limited liability

NOVATEIRRA delivers the booked property in the conditions described in the listing. The platform is not liable for:

  • Force majeure (natural disasters, government decisions, public health emergencies).
  • Damage caused by the guest or by additional guests under the guest’s responsibility.
  • Indirect, consequential or moral damage not foreseen by Mexican law.

Nothing in these Terms excludes the rights that the Federal Consumer Protection Law (LFPC) grants you as a consumer.

8. Intellectual property

All content of the Service (logos, texts, photographs, source code) is the intellectual property of NOVATEIRRA or its licensors. Reproduction, distribution or commercial use without written authorisation is prohibited.

9. Personal data

The treatment of personal data is described in the Privacy notice, drafted under the Mexican Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPPP).

10. Communications

Notifications regarding bookings, payments and changes to these Terms will be sent to the email associated with the account. It is your responsibility to keep that address up to date.

11. Changes to the Terms

NOVATEIRRA may update these Terms. Substantive changes will be notified through the platform and by email with reasonable advance notice. Bookings already confirmed will continue to be governed by the Terms in force at the time of confirmation.

12. Applicable law and jurisdiction

These Terms are governed by Mexican federal law. For any dispute arising from the use of the Service, the parties expressly submit to the jurisdiction of the competent courts of Los Cabos, Baja California Sur, expressly waiving any other forum that may correspond to them by reason of present or future domicile.

For consumer matters, you can also turn to the Federal Consumer Protection Bureau (PROFECO) as established by Mexican law.
